Course Description

This course is offered in partnership with OCAD University School of Continuing Studies   

Building on the knowledge gained in Introduction to IP and IP Strategy for Creative Entrepreneurs, this course, developed in partnership with the Faculty of Law, University of Windsor, Gilbert’s LLP, and eCampus Ontario, explores the law of industrial designs from a practical perspective, including how this body of IP can be used strategically to achieve entrepreneurial objectives. The course provides a wholistic view of what an industrial design is, the exclusive rights that attach to a registered industrial design, and how an industrial design is situated in respect to other forms of intellectual property. The course also examines practical aspects including how an industrial design can be utilized in a business setting, how an industrial design is registered, how the rights in an industrial design can be enforced, and how protection through industrial design is obtained in jurisdictions outside of Canada. The course empowers creative professionals with an understanding of their legal rights, so they may advocate for themselves and engage in informed discussions with legal professionals. 

Learning Outcomes 
Upon successful completion of this course, students will learn: 

  • To understand what an industrial design is and recognize when they might have a design that could be registered in Canada, 

  • To determine if registering their design, as opposed to or in addition to a different form of intellectual property, will assist in achieving their entrepreneurial objectives, 

  • To register a design with the Canadian Intellectual Property Office, 

  • The available options and implications of enforcing the rights in their registered industrial designs. 

Upon successful completion of this course learners will receive a Certificate of Completion. This course requires a series of assignments and learners will be assigned a grade of "complete or incomplete".

Required Software/Supplies 

Regular access to a computer with a high-speed broadband internet connection is required. 

Course Delivery Model 

This course is delivered in an asynchronous online format through a series of tutorials and related assignments which students may complete at their own pace on OCAD’s Learning Management System, Canvas. Each assignment has its own deadline and extensions are not granted.  The instructor is available throughout the course for questions and discussions.

Account Set Up Information and Accessing Your Course 

Step 1: Activate your UWinID for access to your UWindsor Continuing Education Registration System records. 

Step 2: Three days before class, check your email for another registration confirmation email from OCAD U.  This will include your OCAD U user account information, which will grant you access to Canvas, the OCAD Online Classroom and the OCAD Continuing Studies Student Portal.   

Step 3:  On the first day the course is open, please log in at https://canvascloud.ocadu.ca with your OCAD U log in credentials to access your materials. You can reset your password here: https://login.ocadu.ca/forgot. If you need further help, please contact us at continuingstudies@ocadu.ca

Please note you will have an OCAD U username and password for OCAD U systems and a different UWindsor Continuing Education username and password for UWindsor systems. Please save in your notes.
